Roszdravnadzor explains the rules and conditions of remote trade of medicines

Currently, on the territory of the Lipetsk region, 158 organizations are engaged in retail trade of medicinal products for medical use, having 1015 objects of distribution of medicines.

According to the Decree of the President of the Russian Federation of March 17, 2020 "On retail trade in medicines for medical use", pharmacy organizations that have a license to carry out pharmaceutical activities and the corresponding permission of the Federal Service for Supervision in the Field of Healthcare can carry out retail trade in over-the-counter medicines remotely.

Since May 24 of this year, Roszdravnadzor has started implementing the provisions of the Decree of the Government of the Russian Federation No. 697 of 16.05.2020 "On Approval of the Rules for Issuing Permits for Retail Sale of Medicines for medical use by remote means, for such trade and delivery of these medicines to citizens and amendments to certain acts of the Government of the Russian Federation on the issue of retail sale of medicines for medical use by remote means".

These Rules establish the procedure for issuing a permit for the retail sale of medicines remotely, as well as requirements for pharmacy organizations that can carry it out.

In particular, pharmacy organizations should have:

• license to carry out pharmaceutical activities (at least one year);
• at least 10 places of pharmaceutical activity on the territory of the Russian Federation;
• equipped premises (place) for storing generated orders;
• website on the Internet (mobile application is allowed);
• own courier service that has equipment that ensures the maintenance of the necessary temperature conditions for the delivery of thermolabile medicines, or a contract with a courier service that has such equipment;
• an electronic payment system and (or) mobile payment terminals designed for making electronic payments, including using bank cards, directly at the place where the service is provided.

To obtain a permit for remote retail sale of medicines, a pharmacy organization must send an application and documents confirming its compliance with the established requirements to Roszdravnadzor in electronic form.

An application for the state service "Permission for remote trade in medicines" can be submitted on the official website of Roszdravnadzor in the section "Electronic services" https://roszdravnadzor.ru/services

The decision to issue or refuse to issue a permit is made by Roszdravnadzor within 5 working days.

It should be noted that remote trading is prohibited for prescription drugs, narcotic and psychotropic drugs, as well as for alcohol-containing drugs with a volume fraction of ethyl alcohol of more than 25 percent.

We emphasize that citizens should be guided by a number of rules in order to be sure of purchasing high-quality and safe medicines.

In particular, when the buyer pays for a medicinal product in a non-cash form (except for payment using a bank card), the seller is obliged to confirm the transfer of the goods by drawing up an invoice or an act of delivery and acceptance of the goods.

Upon receipt of the order, the buyer must check the integrity of the transport package, independently open it and check the contents of the order with the inventory of the attachment, check the absence of damage to the secondary (consumer) and primary packaging of the drug, and the general proper appearance of the goods.

When receiving an order containing a thermolabile medicinal product, the buyer must ask the delivery employee to demonstrate that the temperature regime at which the medicinal product was stored at delivery corresponds to the storage conditions indicated on its secondary (consumer) packaging.

In case of delivery of an order of improper quality (improper quality of the medicinal product, the delivered order does not correspond to the ordered quantity or composition) the buyer has the right to return it to the delivery employee without paying for the delivered medicinal product and / or its delivery services and / or to demand proper execution of the order.
